How much does probate cost?
For most estates, there are court filing fees of approximately $900 to $2,500.Professional fees to obtain probate commonly fall in the range of $2,000 to $5,000 plus GST.We provide a clear fee estimate at the outset of each matter.
We usually prepare the application for probate within 2-3 weeks of receiving the death certificate and instructions. The Supreme Court of NSW typically takes around 6 weeks to process an application for probate.

Once probate is granted, the executor can begin collecting estate assets and, where appropriate, make interim distributions to beneficiaries.

The full administration of an estate commonly takes around 12 months from the date of death. This allows time to finalise tax affairs and to protect the executor from personal liability for potential claims. However, interim distributions may be made (if appropriate) well before the 12 month mark.

To begin, you will need:
  • A copy of the death certificate
  • The Will (if there is one)
  • A list of the assets owned by the deceased (if known).

It is fine if you do not know all the details at the outset. We can assist with identifying the assets and liabilities.

There is no upfront payment required. Court filing fees and professional legal fees can be paid from the estate once funds become available.
